Festive Rewards 2009 has now ended.
Customers who have qualified will soon receive their claim form from their PFD Food Service Specialist. Once you have your claim form you can complete the form and send it back in the prepaid envelope or claim online at www.festiverewards.com.au .Your rewards will be delivered by your PFD Food Service Specialist.

Festive Rewards 2009 Terms and Conditions
By participating customers accept the terms and conditions in full.
ENTIRE AGREEMENT
The terms and conditions constitute the entire agreement between PFD Food Services Pty Limited and the customer in respect to the Festive Rewards program. PFD Food Services Pty Ltd may, at their discretion and without notice in the conduct of the program may;
- Change, amend or vary these terms and conditions
- Change, amend, vary, withdraw or cancel any rewards or the value of any rewards
- Cancel the program in whole or in part
- Change, amend or vary a customer’s qualification target or the programs products
- Exclude a customer from or cancel a customer’s participation in the program
If a customer is, at any time during the continuance in the program, in breach of its trading terms with PFD Food Services Pty Ltd, PFD Food Services my cancel the customer’s participation in the program without notice. PFD Food Services Pty Ltd is not liable for any loss or damage suffered from any such withdrawals, cancellations or variations to the program made by PFD Food Services in accordance with these terms and conditions.
All decisions pertaining to any disputes under the program or the interpretation of these terms and conditions will be made by PFD Food Service Pty Ltd, whose decision is final and binding
HOW TO CLAIM
At the end of the program PFD Food Services will forward a summary for the total of points accumulated for the period (14/09/2009 – 08/01/2010) on a claim form. A minimum of 5000 accumulated points is required to qualify to enter the program.
A completed a signed claim form must be returned to PFD Food Services, PO Box 208 Ferntree Gully, Victoria 3156 by 5.00pm AEST on Friday 12th February 2010.
It is the responsibility of the customer to ensure the claim form is received by this date.
Customers may claim points online at www.festiverewards.com.au using their claim form number and customer number from their claim form. A minimum of 5000 accumulated points is required to qualify to enter the program.
Online claims must be lodged before 5.00pm 5th February 2010
TAXATION
PFD Food Services Pty Ltd accepts no liability in respect to any taxation liability (including fringe benefits tax) of reward recipients, arising from the redemption of rewards. All rewards are valued including of GST. Reward recipients should seek their own independent advice on any taxation implications that may arise from the rewards.
AUTHORITY
Rewards will be issued on the understanding that the person claiming the rewards is authorised to do so on behalf of the business. Rewards claimed by the registered clubs are subject to dispersal in accordance with the laws and regulations applying to registered clubs in each state or territory.
CONDITIONS OF ENTRY
“YOU DESERVE THE CREDIT PROMOTION”
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via facsimile only.
- Entry into the promotion is only open to existing PFD Food Services Customers or those who become PFD Food Services Customers during the promotional period, who are aged 18 years or older and residents of Australia (except Northern Territory). If the PFD Food Services Customer is a business it must nominate one (1) authorised representative, who is aged 18 years or older, to enter the promotion on its behalf. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.
- To enter the promotion, eligible entrants must purchase any twelve (12) products (by the carton) (“Qualifying Purchase”) from the 2009 Festive Rewards Program on one (1) invoice during the promotional period and fax their invoice to 03 9763 6129.
- Multiple entries into the promotion will be accepted, however only one entry per Qualifying Purchase permitted, each entry must be submitted separately and must fully comply with the entry requirements set out in these Conditions of Entry.
- Entrants must be within the Promoter’s trading terms for the duration of the promotional period to be eligible to win a prize.
- Entries must be received by the Promoter during the promotional period. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
- The charges for all faxes will appear on each entrant's next telephone carrier bill and will not exceed 55c per complete fax. All queries relating charges must be directed to the entrant’s telephone carrier.
- Promotion commences at 12:01am (AEST) on 14/9/2009 and closes at 11:59pm (AEDT) on 8/1/2010. The draw dates and times for each promotional draw are as stated below in Condition 9. Each draw will take place at 6 Henderson Road, Knoxfield, VIC, 3180. All winners will be notified by telephone and mail or email and their names and localities will also be published in The Australian on the dates set out in Condition 9. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

- There will be three (3) promotional draws with a hundred (100) winners in total who will each win $1,000.00 worth of credit to their nominated Food Services PFD account:
- Draw 1 - the first forty (40) eligible entries randomly drawn from all eligible entries received from 14/9/2009 until 31/10/2009 will be winners.
- Draw 2 - the first thirty (30) eligible entries randomly drawn from all eligible entries received from 1/11/2009 until 30/11/2009 will be winners.
- Draw 3 - the first thirty (30) eligible entries randomly drawn from all eligible entries received from 1/12/2009 as at 8/1/2010 will be winners.
- Total maximum prize pool value is $100,000.00. Prizes are not transferable, not exchangeable, not redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The prizes are subject to the Promoter’s prevailing terms and conditions of use, available at www.pfdfoods.com.au.
- The Promoter may conduct such further draws at the same time and place as the original prize draws as are necessary on 13/4/2010 in order to distribute any prize if unclaimed by that date, subject to any written directions given under the applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winners will be notified by telephone and mail or email and the winners’ names and localities will be published in The Australian on 22/4/2010.
- Each eligible entrant must retain and may be required to present proof of purchase in order to claim a prize. Entrants may be requested to provide to the Promoter proof of purchase for all entries made. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes showing the original and providing a photocopy of the invoice for each Qualifying Purchase.
- Entrants can only enter in their PFD Food Services account name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each winner’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will be deemed invalid. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
- The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- If any prize or any element of the prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State or Territory legislation.
- The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Caution: any attempt to deliberately damage the Promoter’s telephone applications to cause malicious damage or interference with the normal functioning of the Promoter’s telephone applications or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
- The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
- If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
- Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation or further reference for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
- All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published each winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter at the address below. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
